GENERAL TERMS AND CONDITIONS
These General Terms and Conditions (hereinafter the "Terms") govern the conclusion of purchase contracts between 3MARKET International s.r.o. and its customers, and the related legal relationships, provided that such contract is concluded through the online store located at the internet address www.3market.cz (hereinafter the "E-shop").

2. GENERAL PROVISIONS
2.1. These Terms are binding on both parties from the moment a purchase contract is concluded. They form an integral part of the contract.
2.2. The contract and these Terms are drawn up in the English language.
2.3. A Customer can be either a Consumer or a Professional (Business entity). A Consumer is an individual acting outside the scope of their trade, business, craft, or profession.
2.4. Cross-Border Protection: These Terms respect consumer protection rules applicable within the European Single Market, specifically targeting consumers in Lithuania, Latvia, Estonia, Denmark, Hungary, Romania, Bulgaria, Slovenia, Croatia, and Greece. Mandatory local consumer protection laws of the consumer’s country of residence that provide higher protection than Czech law will apply where required by EU Regulation No 593/2008 (Rome I).
3. PRICES AND ORDERING PROCESS
3.1. Prices in the E-shop include VAT, packaging, and all statutory fees. Shipping and payment method fees are excluded and will be added during the checkout process before order completion.
3.2. To place an order, the Customer adds the Goods to the shopping cart, selects the country of delivery, currency, shipping method, and payment method, and fills in the required billing/delivery information.
3.3. The contract is concluded at the moment the order confirmation is successfully delivered to the Customer's email address.
4. PAYMENT CONDITIONS
4.1. The Customer agrees to pay the purchase price and shipping costs using one of the following methods:
Online card payment via Comgate payment gateway;
Apple Pay;
Bank transfer.
4.2. Payments by bank transfer or electronic gateways are due within 5 days from order confirmation. If the payment is not received within this period, 3Market reserves the right to withdraw from the contract.
4.3. Goods will be dispatched only after the full payment is credited to 3Market's account. An electronic invoice will be sent to the Customer's e-mail.
5. DELIVERY AND SHIPPING
5.1. Delivery options include standard shipping to addresses or designated pick-up points via international courier services (including Zásilkovna/Packeta networks, GLS, PPL, or local postal partners operating in Denmark, Hungary, Romania, Bulgaria, Greece, the Baltic states, and the Adriatic region).
5.2. The Customer is obliged to accept the Goods upon delivery. If the delivery fails due to reasons on the Customer's side, the Customer shall bear the costs of repeated delivery.
5.3. Upon receipt, the Customer is obliged to inspect the packaging integrity. If the package shows signs of unauthorized opening or severe damage, the Customer has the right to refuse it, must write a damage protocol with the carrier, and notify 3Market immediately.
6. RIGHT OF WITHDRAWAL (14-DAY COOLING-OFF PERIOD)
6.1. Consumers residing in the EU have the right to withdraw from the contract without giving any reason within 14 days. The withdrawal period expires 14 days from the day the Consumer (or a designated third party) acquires physical possession of the Goods.
6.2. Exceptions: The right of withdrawal does not apply to:
Goods made to the Consumer’s specifications or clearly personalized;
Sealed goods which were unsealed after delivery and are not suitable for return due to health protection or hygiene reasons;
Goods which are liable to deteriorate or expire rapidly.
6.3. To exercise the right of withdrawal, the Consumer must inform 3Market via an unequivocal statement (e.g., a letter sent by post or e-mail to info@3market.cz). The Consumer can use the withdrawal form provided below.
6.4. The Consumer must send back the Goods to the premises at Kopaninská 73, 252 25 Ořech, Czech Republic without undue delay and no later than 14 days from the day of withdrawal notice. The Consumer bears the direct cost of returning the Goods.
6.5. 3Market will reimburse all payments received, including standard delivery costs, within 14 days of receiving the withdrawal notice. However, 3Market may withhold reimbursement until the Goods are received back or the Consumer supplies evidence of having sent back the Goods.
7. RIGHTS FROM DEFECTIVE PERFORMANCE & WARRANTY
7.1. 3Market warrants that the Goods are free from defects upon delivery, possess the described characteristics, fit the intended purpose, and comply with all legal regulations.
7.2. For Consumers in the EU, a statutory warranty period of 24 months applies to all new consumer goods, starting from the receipt of the Goods.
7.3. Complaints can be submitted via email to info@3market.cz or by shipping the defective product to the return address. The Customer should provide a description of the defect, order number, and preferred remedy.
7.4. Remedies for Defects:
For Material breach of contract: The Customer may request repair, a reasonable price discount, delivery of a new defect-free item, or withdraw from the contract entirely.
For Immaterial breach of contract**: The Customer may request repair or a reasonable price discount.
7.5. For Consumers, complaints will be assessed and resolved without undue delay, strictly within a maximum of 30 days from the date the complaint was lodged, unless a longer period is explicitly agreed upon.
8. ONLINE DISPUTE RESOLUTION (ODR)
8.1. In case of an unresolved dispute between 3Market and an EU Consumer, the Consumer has the right to initiate an out-of-court settlement via the European Commission's Online Dispute Resolution platform accessible at: http://ec.europa.eu/consumers/odr.
8.2. Customers can also contact their local European Consumer Centre (ECC) for free advice and assistance regarding cross-border purchases within the EU.
9. FINAL PROVISIONS
9.1. All legal relationships arising from or in connection with these Terms shall be governed by the laws of the Czech Republic. However, this choice of law does not deprive EU consumers of the protection afforded to them by mandatory provisions of the law of their country of habitual residence.
9.2. These Terms become effective on February 20, 2026.
